Shipment stuck in Customs/ return is needed

Hello, i sent a shipment from japan to a forwarding company in china but the shipment is stuck in the customs since 8th of Nov. "no one there to pay the tax nor customs clearance"
i contacted EMS China many times about the shipment status and when it will return to the seller in japan and they told me many times that " it will return after 1 Month "
but today my shipment completes its 44 days..
without any updates and i need a help..
so please help me with this Tragedy.

Okay but will my package return to the sender if there is no one do the clearance or not ?

It usually will be stuck at the customs for a months and if no one do the clearance, it will be returned back.
